Warning Issued After Crossing Guard Struck by Vehicle

The North Bay Police Service (NBPS) is reminding all motorists public that every driver MUST stop and/or follow the direction of crossing guards after receiving repeated complaints, including one that saw a crossing guard struck by a vehicle in the south end of the city. Thankfully, the injuries were not life-threatening, but the incident underscores the serious risk posed when drivers fail to obey the law.

“Disobeying a crossing guard isn’t just illegal, it’s a potentially fatal choice,” said Sergeant McClenaghan of the NBPS Community Response Unit. “Let’s obey the law, protect our most vulnerable, and ensure a safer future for all.”

The Law

A crossing guard’s stop sign carries the same legal authority as a stop sign at an intersection. Under the Highway Traffic Act, when a crossing guard displays a stop sign, drivers must stop before reaching the crossing and remain stopped until all pedestrians, including the guard, have safely cleared the roadway. Crossing guards are trained and stationed throughout North Bay to manage traffic and create safe opportunities for pedestrians, especially children, to cross the road.

Failing to obey a crossing guard can result in a $730 fine in a community safety zone and four demerit points. The maximum penalty is $1,000 and four demerit points. NBPS is committed to protecting children and school crossing guards. Members will conduct targeted enforcement in identified hotspots to ensure compliance and enhance road safety.

Safety Reminders for Drivers

  • Pedestrians always have the right of way when crossing lawfully.
  • Slow down when approaching school zones and crossings.
  • Always obey the crossing guard’s directions.
  • Make eye contact with the guard or pedestrians.
  • Stop immediately when a guard raises the stop sign.
  • Remain stopped until everyone, including the crossing guard, is safely on the sidewalk.

If you see a driver disobey a crossing guard, try to record:

  • The vehicle’s license plate number
  • The make, model, and colour of the vehicle
  • A description of the driver
